This whole thing borders on violating the 3rd. Ammendment, while violating the 10th. Ammendment and 5th. Ammendment. Anything not listed in the Constitution is automatically given to the states. In this case, there’s nothing that says the president can order national guard to deploy on US soil during peacetime.
Furthermore, it is the responsibility of the government to prove someone is guilty of a crime (in this case, illegally crossing the border). ICE is rounding people up and declaring them non-citizens without giving due process where they prove people broke the law.
